1. How to Enter: Sweepstakes begins on February 24, 2010 and ends on March 10, 2010 (the “Promotion Period”). To enter the Sweepstakes: Tweet the following statement about our site to your friends and family on Twitter.com and become a follower of us @Wellness_Daily with the line: “Enter to win $ towards a gym membership & JENNIE-O turkey products. Just follow @wellness_daily & RT this. http://bit.ly/tbd123.” Limit of one entry per person. Jennie-O Turkey Store (“Jennie-O”) employees, promotion and judging agencies, each of their respective parents, affiliates, divisions, and agencies, and all of the foregoing entities’ respective employees, officers, directors, shareholders and agents (the “Released Parties”) are not responsible for incorrect or inaccurate transcription of entry information, human or printing errors, or for late, lost, incomplete, stolen, misdirected, mechanically reproduced, or illegible and/or postage-due mail or entries. All entries become the property of Sponsor.
2. Eligibility: Sweepstakes open only to legal residents of USA who are 18 years of age or older at time of entry. Jennie-O employees, promotion and judging agencies, each of their respective parents, affiliates, divisions, and agencies, and their respective immediate families (spouse, parents, children and siblings and their respective spouses) and household members of each are ineligible to enter or win. Sweepstakes subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
3. Random Drawing: One (1) Grand Prize winner and One (1) First Prize winner will be selected in a random drawing from all eligible entries on or about March 15, 2010 by Burson-Marsteller, an independent judging organization whose decisions on all matters pertaining to the Sweepstakes are final. All properly claimed prizes will be awarded. Odds of winning depend on the total number of eligible entries received during the Promotion Period. Limit of one prize per person, family or household. Winners will be notified by phone and/or mail, and may be required to sign an affidavit of eligibility (which affirms that they have complied with these Rules) as well as a liability release, and, where legal, a publicity release, all of which must be completed, signed and returned within fourteen (14) days from date on which the documents are sent to the prospective winner or the prize will be forfeited and awarded to an alternate winner. Acceptance of a prize constitutes permission for Sponsor to use winners’ names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law.
4. Prize: One (1) Grand Prize: a 1-year gym membership - ARV: $750.00. One (1) First Prize: a 1-year supply of Jennie-O Turkey Store coupons – ARV: $500.00. Total Approximate Retail Value (“ARV”) of all prizes: $1250.00. Odds of winning are dependent on number of eligible entries received. All taxes, fees and any other expenses not specified herein, including without limitation, income taxes, related to the prize awarded and its receipt are the sole responsibility of the winner. No prize substitution or transfer of prize permitted except by Sponsor. If a potential winner does not wish to accept the prize, an alternate will be selected from the pool of eligible entrants. By entering, participants agree to be bound by these Official Rules and agree to release and hold harmless the Released Parties from and against any and all claims, actions and/or liability for any injuries, loss or damage of any kind arising from or in connection with participation in and/or entry into this Sweepstakes or acceptance and/or use of any prize won. All details of a prize not set forth herein shall be determined by Sponsor, in its sole discretion.
5. General Conditions: By participating, entrants release, discharge, and hold harmless the Released Parties from and against any and all liability, claims, or damages arising out of their participation in the Sweepstakes and/or the acceptance, use, misuse, non-use or possession of any prize. The Released Parties are not responsible for printing or typographical errors in any Sweepstakes-related materials or for stolen, lost, late, misdirected, damaged, incomplete, postage-due, and/or illegible entries or mail. If, in Sponsor's opinion, there is any suspected or actual evidence of tampering with any portion of the Sweepstakes, or if fraud or actions by entrants, compromise, corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual and/or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prizes using all non-suspect eligible entries received as of the date of such action.
